The supreme court rules US Citizenship is a a right for children born in the United States!

Washington, Jun 30 (EFE).-

The United States Supreme Court ruled Tuesday that President Donald Trump’s executive order limiting citizenship for people born on US soil to undocumented parents or those with temporary visas is illegal.

“Children born in the United States to parents unlawfully or temporarily present are ‘subject to the jurisdiction’ of the United States and are citizens at birth under the Fourteenth Amendment’s Citizenship Clause,” the opinion, written by Chief Justice John Roberts, said.

​The decision was adopted by a vote of five in favor and four against among the justices, upholding an interpretation of the Constitution that for over 150 years has considered nearly anyone born within the nation to be an American citizen, with exceptions such as the children of diplomatic officials.

​Justice Brett Kavanaugh partially dissented, as he did not share the maximalist interpretation of the citizenship clause, nor did he endorse Trump’s executive order, which would effectively eliminate birthright citizenship.

​Three other justices considered conservative dissented from the majority opinion by not recognizing birthright citizenship as “entirely” automatic.

​Trump promised during his campaign to limit automatic citizenship for the children of undocumented immigrants, a measure he signed into law on the very day he began his second term, Jan. 20, 2025, ushering in a period of restrictive anti-immigration policies.

​The order, which would have affected some 255,000 children per year, has been overturned by the Supreme Court’s decision, which analyzes what it means to be a US citizen.

The US president argued that the Fourteenth Amendment has been misinterpreted and claimed that the US is the only country that automatically grants citizenship to those born on its soil, a false claim, since some 30 countries around the world also recognize that right.

Trump has claimed that the Fourteenth Amendment, adopted after the Civil War (1861–1865) to correct the 1857 “Dred Scott v. Sanford” ruling and guarantee citizenship to former slaves and their descendants. EFE
