Washington, Aug 29 (EFE).-

A United States federal appeals court ruled Friday that US President Donald Trump acted outside his legal authority when he imposed tariffs on dozens of countries, declaring most of the measures unlawful. However, the court allowed the tariffs to remain in effect while the case could move to the Supreme Court.

The US Court of Appeals for the Federal Circuit upheld a May decision by a specialized trade court in New York that had questioned the legality of Trump’s tariffs.

Judges said Trump “overstepped his authority” by invoking the 1977 International Emergency Economic Powers Act (IEEPA), a law designed to be used only in genuine emergencies.

“The president lacked the legal basis to impose these tariffs under IEEPA,” the ruling stated, emphasizing that the statute cannot be used as a blanket tool for trade disputes.

The ruling affects tariffs Trump imposed on key trading partners, including China, Canada, and Mexico, as well as recent duties applied to Indian imports.

These measures, central to Trump’s trade agenda, were among the most controversial of his presidency.

At the same time, the court clarified that tariffs on automobiles, steel, and other imported goods remain unaffected because they were enacted under different legislation.

Despite the legal setback, Trump’s tariffs will remain in place temporarily.

“The decision intends to allow time for a potential appeal to the Supreme Court,” the appeals court noted. EFE
