Judge Trina Thompson revives TPS for 60,000 Migrants!

New York, US, Dec 31 (EFE).-

A federal judge declared illegal the cancellation of Temporary Protected Status (TPS) for over 60,000 immigrants from Nicaragua, Honduras, and Nepal.

​Judge Trina Thompson, from California, considered that the Secretary of the Department of Homeland Security, Kristi Noem, ordered the cancellation of this migratory benefit in a “preordained” manner and failed to comply with the procedure established in the law.

​The judge, who restored TPS for the affected nationalities, rejected a government request to dismiss the case and explained that Noem did not follow the habitual DHS practice by reducing the transition period after the TPS termination to 60 days.

​Thompson declared that the termination of TPS for Nepal on June 6, 2025, and for Honduras and Nicaragua on July 7, 2025, was illegal under the APA (Administrative Procedure Act) and invalidated Noem’s order.

​“Unilateral power has never been American. Nor has this country ignored the importance of humanitarian relief,” Thompson wrote in the opening of her 52-page order.

​ “By complying with the Constitution and enforcing the purpose of the temporary protected status statute, this nation’s economy becomes strengthened, and our society united,” she added.

​Several organizations representing the TPS beneficiaries reacted positively to the judicial decision but lamented that the cancellation of the benefit has already harmed many people who have been in the country for decades.

​TPS is a type of migratory benefit that the DHS can grant to migrants from countries going through emergency situations, such as natural disasters or armed conflicts, that prevent them from returning safely. EFE
