In May, the New Jersey Department of Labor and Workforce Development (NJDOL) added 11 companies to its Workplace Accountability List (The WALL), bringing the number of employers that have not addressed their outstanding liabilities for wage, benefit, or tax law violations to 272. Any business whose name appears on The WALL is prohibited from publicly contracting with state, county, or local governments until they fully pay their liabilities.

The 11 companies owe a total of $464,817.40 in unpaid contributions, penalties, and interest to the Unemployment Compensation Fund and the State Disability Benefits Fund. Currently in the second year of the WALL initiative, there are 272 companies in The WALL, collectively owing $25.5 million, either directly to their workers or to the state in unpaid taxes or contributions.

No businesses were removed from The WALL in May. To date, the NJDOL has recovered $613,208.63 in outstanding liabilities from businesses that have been included in The WALL or that have been warned that their business would be added to The WALL if they did not resolve their outstanding liabilities.

The WALL is a powerful enforcement tool that allows the department to publicly name companies that deceive their workers and fail to make required contributions to programs such as unemployment insurance and workers’ compensation. Companies on the list have failed to resolve their outstanding fines and fees with the NJDOL and the Treasury.

The initiative was established through a bipartisan action (S-4226) in 2020 as part of an effort to combat worker misclassification and exploitation. It gives the NJDOL the power to protect fair businesses across the state from employers who disadvantage their workers to gain a competitive advantage.

Posting on The WALL is separate from, and may be in addition to, other accountability measures, such as debarment of public contractors and suspension or revocation of business licenses. State, county, municipal, and school procurement officials should consult The WALL before awarding public contracts, just as they do with the debarment list.

Businesses receive letters warning that their company name will be listed on The Wall unless they resolve their outstanding liabilities; they are given 20 days from the date they receive the notice to pay in full or contest their pending listing on The Wall.

The WALL went into effect in September 2023. Additional companies with pending violations are added monthly.
